3. User Accounts and Eligibility

You must be at least 13 years old to use this App. If you are under 13, you may not use the App. If we discover that a user is under 13, we will terminate their access immediately.

3.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Ensuring your account information is accurate and up-to-date

4. Intellectual Property Rights

4.1 Our Content

The App and its original content, features, and functionality are owned by FC 26 AI Card Generator and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 User-Generated Content

When you create cards using the App:

• You retain ownership of the images you upload
• You grant us a limited license to process and display your images within the App

4.3 Disclaimer

5. Prohibited Uses

You agree NOT to use the App to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload offensive, illegal, or harmful content
• Impersonate any person or entity
• Transmit viruses, malware, or harmful code
• Attempt to hack, reverse engineer, or disrupt the App
• Use the App for commercial purposes without authorization
• Upload images of minors without parental consent
• Create or distribute cards containing hate speech, violence, or illegal content
• Bypass or circumvent premium features or payment systems

6. In-App Purchases and Subscriptions

6.1 Premium Features

The App offers premium subscriptions through Apple In-App Purchases that provide:

• Unlimited card generation
• Access to all card types
• No watermarks on saved images
• Priority support

6.2 Subscription Terms

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel subscriptions in your Apple account settings
• No refunds for partial subscription periods

6.3 Pricing

Subscription prices are displayed in the App and may vary by location. We reserve the right to change prices with notice to existing subscribers.

6.4 Refunds

All purchases are processed through Apple's payment system. Refund requests must be submitted through the Apple App Store according to their refund policy.

7. Content Guidelines

7.1 Uploaded Images

When uploading images, you must ensure:

• You own the rights to the image or have permission to use it
• The image does not contain illegal, offensive, or inappropriate content
• The image does not violate anyone's privacy or publicity rights
• The image does not infringe on copyrights, trademarks, or other IP rights

7.2 Created Cards

You are responsible for the content you create. We reserve the right to remove content that violates these Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of content
• Warranties that defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Any damages arising from your use or inability to use the App

Our total liability shall not exceed the amount you paid for the App in the last 12 months, or $100, whichever is less.

10. Indemnification

You agree to indemnify and hold harmless FC 26 AI Card Generator and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you upload or create using the App

11. Termination

11.1 By You

You may stop using the App at any time by deleting it from your device.

11.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Any reason we deem necessary to protect our interests or other users

11.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and content
• Subscription payments will continue until the end of the current billing period
• Provisions that should survive termination will remain in effect

12. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to our privacy practices.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last updated" date
• Sending an in-app notification or email (for significant changes)

Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Turkey.

15. Dispute Resolution

15.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with Turkish law, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FC 26 AI Card Generator regarding the use of the App and supersede all prior agreements.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites or services.

20. Apple App Store Requirements

These additional terms apply if you download the App from the Apple App Store:

• These Terms are between you and FC 26 AI Card Generator, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• In case of failure to conform to warranties, you may notify Apple for a refund, and Apple has no other warranty obligation
• Apple is not responsible for addressing claims relating to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
